When you make use of the Retail Loyalty Congress mobile application (hereinafter referred to as ‘Application’), Brand Loyalty International B.V.(hereinafter referred to as ‘BrandLoyalty’, ‘we’, ‘us’, ‘our’) processes personal data and uses cookies and similar technologies. We aim to carefully and safely use your personal data in line with applicable privacy rules and regulations. 

In this Privacy Statement we describe who we are, how and for which purposes we process your personal data, how you can exercise your privacy rights and all other information that may be relevant to you. 

We did our best to provide you with all information in a clear and readable format. However, if you have any questions about the use of your personal data after reading this Privacy Statement, you can always contact us through the contact details provided at the bottom of this Privacy Statement.  

For information on how we use cookies and similar technologies, please read the information under the headline “Which cookies do weuse?”.

Finally, we would like to point out that we are continually developing and improving the Application. If this changes the way we process your personal data, we will inform you through this Privacy Statement. We therefore recommend you to regularly take notice of the Privacy Statement for any modifications.

Who are we? 

We, BrandLoyalty, are responsible for processing your personal data as described in this Privacy Statement and qualify as ‘data controller’ under applicable data protection laws. We are established at Koningsweg 101, 5211 BH ‘s-Hertogenbosch, The Netherlands. If you want to contact us, please use the contact details provided at the bottom of this Privacy Statement. 

Twoppy B.V. (Appendee) is the service provider used as host and manager of the Application on behalf of us. 

 

Which personal data do we collect from you?

We receive several categories of personal data when you make use of the Application. Note that the Application is only used by invited users only. The categories of personal data can be divided into groups:

  1. Required minimum personal data:
  • Personal details (first name, last name);
  • Contact details (e-mail address);
  • Usage data (technical user segment).

Note: Within the Application processing of these personal data is necessary for creating your account and for sending you an e-mail invitation to activate your account. Therefore, some personal data will be automatically transferred from the registration website to the Application. 

 

  1. Optional personal data which will be processed if you choose to insert this information yourself to create a personal profile:
  • Personal details (personal biography, social media);
  • Sensitive details (personal photo);
  • Company details (job title, address, zip code, country);
  • Event planning (sessions marked as favourite);
  • Interaction details (chats with fellow participants).

 

  1. Optional personal data which will be processed after explicit consent given through the invitation e-mail:
  • Travel information (personal flight/hotel schedule) – this data will not be shared with other participants.

For which purposes do we process your personal data?

We collect and process your personal data to make sure you can use the Application properly. This means you can easily access and use the Application during the availability of the Application and during your participation at the Retail Loyalty Congress 2019. 

We also made it possible for you to make your profile even more personal, to chat with your fellow participants, to review your personal travel itinerary, to keep up-to-date about your stay at the event, mark sessions as favourite in order to create a personal schedule and to receive helpful notifications.  

In addition, we use the data in a pseudonymous or anonymous form to understand how we can develop and improve the service, as well as for reporting purposes, statistical and analytical purposes. When necessary we process personal data to fulfil a legal obligation. 

On what legal ground do we base the processing of your personal data? 

We base the processing of your personal data within the Application on several legal grounds:

Performance of a contract.If you download, install and use the Application you agree to the terms and conditions and therefore you enter into a binding agreement with us. We use your personal data for processing necessary for performance of the service contract with you, i.e. the services associated with providing a personalised event Application.

For the legitimate interest pursued by us.The processing of your personal data is necessary to understand how we can develop and improve the service, as well as for reporting purposes, general statistical and analytical purposes. In addition, we shall process the personal data voluntarily provided by you to be able to provide you the requested services. Processing personal data for these purposes serves a legitimate business interest of us and has no or limited impact on the data subject’s privacy, because data is used in a pseudonymous or anonymous form when possible. 

Given consent.You may freely and based on specific information provided – e.g. in this Privacy Statement – choose to download and use the app, provide your personal data at your own initiative, share your personal data with fellow participants, receive helpful push notifications and review your travel itinerary in the Application. When you choose to use these options, you thereby consent to the processing of data for such purposes by us and/or other participants. Direct messages you send to fellow participants are only visible for the individual recipient, travel information will not be shared with fellow participants and the Application is exclusively offered to invited users only. Note that you can always withdraw your given consent. Under the headline ‘Can you withdraw you given consent later on?’  you can read how to do so.  

For compliance with a legal obligation. We may process personal transactional data when necessary to comply with tax, fiscal and other legal obligations.  

Please be aware that the processing of the data categories for the purposes, as mentioned above, are based on one of the legal bases mentioned (depending upon the specific data category and sub purpose at stake), and not all legal bases simultaneously.

Depending on the applicable privacy laws, in some countries processing personal data is based on your consent. Acceptance of this Privacy Statement constitutes consent to the terms stated in this Privacy Statement. Consent can be withdrawn by you by sending an email to the contact details provided below.

To whom dowe provide your personal data? 

Your personal data is shared with a limited number of carefully chosen third party service providers who support us in providing you with the Application according to this Privacy Statement and in so far as permitted by law. We take full responsibility for third party service providers performances when processing your personal data. We ensure that they maintain an appropriate level of data protection. Without your explicit consent we will not provide your personal data to third parties for their own marketing purposes.

Is your personal data being transferred outside the country where you are located?   

Your personal data may be transferred outside the country where you are located, depending on your place of residence. We will transfer your personal data to the European Economic Area, as this is necessary for providing our services to you. We have taken all necessary measures to secure that the transfers take place within the limits set by law. 

How long do westore your personal data?

Your personal data will be removed or made anonymous when your personal data is no longer necessary for the purposes for which these personal data are processed.

 

How can you exercise your privacy rights? 

At every desired moment you may request to access, rectify or erase your personal data. 

In addition, you may in certain cases also have the right to restrict the processing of your personal data, the right to object to processing as well as the right to data portability.

Can you withdraw your given consent? 

If you no longer want to use the app or have it collect usage data, or to have your personal data stored within the Application, you may delete the app. If you want to redraw your consent, please contact us via the contact details at the bottom of this Privacy Statement.

In addition, you can manage your push notification preferences or deactivate the push notification at any time by turning off the notification setting in the settings of your device. You also have the option to manage your preferences with regards to the access of your personal profile by fellow participants by switching the share button in the Application.

Please keep in mind that withdrawal does not have retrospective effect and the withdrawal of your consent is only possible in case you first have given your consent.    

Can you lodge a complaint? 

You can lodge a complaint with your local data protection supervisory authority when you have a complaint about the use of your personal data.

Are you obliged to provide your personal data to us and what are the consequences if you do not? 

If you choose to use the Application some personal data collection is necessary, which means that you can’t use the service without providing this data. Where optional, such as uploading a profile picture, connecting with fellow participants, making your profile more personal and receiving of push notifications, you are free to provide consent or to refrain from using this feature.  

Do we use profiling techniques or make automated decisions? 

We do not use profiling techniques and/or any kind of automated decision-making. 

Which cookies do we use?

The Application uses Google Analytics whereby only functional and analytical cookies will be used. Functional cookies are necessary for a proper functioning of the Application. For example, a functional cookie makes sure you don’t have to login on every separate page you visit and keeps track of the amount of collected stamps. Analytical cookies help us to improve our services whereby we are able to count our application visitors and see how visitors make use of our application. With both analytical and technical cookies, we will not receive any personal data.
